Abstract

Legal protection of a software appears to be made under the rules of copyright in the majority of states including Romania, but mustn’t be forgotten the old, but unfinshed, discution about legal nature betwen copyright law, pattent law and suis generis rules. 

In European Union, under the rules of Directive 2009/24/EC and in corollation with the rules of the European Patent Convention, the computer program is protected by copyright, but it’s specifficaly excluded as a software as it’s own from pattent protection. 

Copyright appears to be a solution adopted by the majority of states all around the world. But the things aren’t so simple since, for example, in United States of America even if Bern Convention it is appliable, the most of software industry is protected by the pattent law, in contrast to Europe. Here, software as it’s own isn’t removed from pattentability.

And mustn’t be forgetten the ideea, wich is increasingly more often found in doctrine, of a suis generis protection designed especially for this complicated, inovative and fast foward field of science.
