Abstract

According with its name, the proposed study analysis the provisions of art. 8 from Law no. 64/1991 regarding patents, established for the technical creations which are not granted patent. 

This analysis is performed, especially in correlation with art. 53 of the European Patent Convention and art. 27 of the Agreement on aspects of trade related intellectual property rights (the TRIPS agreement).

As far as we are concerned, we consider this analysis very useful, especially as the Romanian legislator, in some aspects, derogated from the European regulation and, in other respects, from the International ones.
