Abstract
In order to have access to copyright protection, works need to meet certain conditions; however, the conventional and legal rules, while indicating some, do not explain them, and the silence of the law leaves the notion of originality to be developed by national case law and especially the legal doctrine.
The author analyses the criterion of the originality of the works by applying the rule “no other criterion” from the E.U. copyright, pursuing theoretical and practical consequences.
