Abstract

 The article aims to revisit a few points raised in our previous article on this matter published 10 years ago. Thus the divergence in denominations used and proposals explicitly made in this regard in the legal litterature are analyzed. Moreover we shortly point to the justification for the creation of these mechanisms within copyright law and to the importance of an ex ante analysis of the economic justifications for such, based on as much as possible objective criteria.
