Abstract
The European patent with unitary effect presents a complex legal figure in the field of industrial property. It is the result of enhanced cooperation of the Member States of the European Union in the field of patents. The intention was to create a European intellectual property right, starting from the provisions of art. 118 of the Treaty on the Functioning of the European Union. This article addresses the problem of the unitary effect of the European patent, as it is regulated under article 3 of the Regulation no. 1257/2012. At the same time, the provisions regarding the European patent with unitary effect as an object of property and the effects of a European patent with unitary effect are examined.
