Abstract
The subject regulated by Law no. 206/2004 is nowadays more than ever of interest, plagiarism rising both ethical and legal problems that increasingly affect the modern scientific society. However, the legal regulations concerning this matter are far from being coherent, the inconsistency and the lack of certain provisions making it difficult to enforce starting with establishing which court is competent to rule. The current regulations cause an unjustified merger between disciplinary and ethical liability even if these two forms of liability are and should stay separate. This study is an analytical approach of current regulations concerning ethical liability, including de lege ferenda propositions ment to complete or clarify the legal frame in existence.
