Abstract
Designs are those intellectual creations consisting of ornamental and functional elements benefiting from legal protection under the dome of industrial property law subject to the fulfilment of the validity requirements for the registration. Also, designs become works of applied art in the field of copyright thus benefiting from a double legal protection in the light of the regulation of the protection cumulation system. In this paradigm, we shall analyse from the perspective of the European case law how the creativity and the aesthetic value of the ornamental elements
influence the granting of protection through copyright concerning a design within the equation of the legal protection cumulation system.
